2. Small-producer thresholds next to your figures

For your decision. Thresholds checked November 3, 2026.
StateThreshold (source)Your figuresWhat the figures show
CaliforniaGross sales in California of less than $1 million in the most recent calendar year. (Cal. Pub. Res. Code §42060(a)(5), CalRecycle: Exemptions and exclusions)California sales of $1 million or moreNot under $1 million, so the exemption application is not open on these figures.
OregonGross revenue of less than $5 million in the most recent fiscal year, or less than 1 metric ton of covered products sold into Oregon in the most recent calendar year. (ORS 459A.863(32) and 459A.872, Oregon DEQ: Producer exemptions, Oregon DEQ: Exemptions FAQ (updated October 26, 2026))Revenue about $11 million; 62,210 lb (about 28 metric tons) into OregonAbove both lines on these figures.
ColoradoRealized gross total global revenue of less than $5,779,297 in the prior calendar year, not counting on-premises alcohol sales, or less than 1 ton of covered materials used for products sold into Colorado in the prior calendar year. (HB22-1355, C.R.S. 25-17-713(1) (signed act), CDPHE: Solid waste rulemakings (6 CCR 1007-2 Part 1, effective July 15, 2026))Revenue about $11 million; 78,090 lb (about 39 tons) into ColoradoAbove both lines on these figures.

(RCW 70A.208.020(16))Revenue about $11 million; an estimated 41,000 lb into WashingtonAbove both lines on these figures.
MinnesotaLess than 1 ton of covered material introduced into Minnesota, or global gross revenue of less than $2 million, in the most recent fiscal year. (Minn. Stat. 115A.1441, subd. 13 and 26)Revenue about $11 million; an estimated 19,500 lb into MinnesotaAbove both lines on these figures.

Oregon’s law says metric ton. Colorado, Washington, Minnesota and Maryland say ton without naming a unit, so if you are close to 1 ton, check the state’s guidance or ask CAA.

3. Which states’ rules may apply, and what is next

4. Exemptions worth reviewing

  • Oregon bottle bill. Beverage containers covered by Oregon’s bottle bill are outside Oregon’s program, but their cartons and shippers are not (Oregon DEQ: Producer exemptions). Worth confirming for your bottles. Oregon’s 2027 glass rate is $0.00 per lb, so the fee effect is small either way.
  • Transport packaging in Oregon. CAA’s Oregon schedule has a separate category, at $0.00 per lb in 2027, for non-consumer tertiary and transport corrugated. Shippers that only move cases to grocers’ warehouses may belong there.
  • California small-producer exemption. Not open on your figures, because California sales are $1 million or more.

5. 2027 fee estimate

CAA invoices 2027 fees in two halves, in January and July, from the supply you reported in 2026 (CAA 2027 Oregon schedule). Category mapping here is simplified; a full check maps every component, including labels and liners, against CAA’s reporting guidance.

Oregon: sample 2027 fee estimate. Fictional weights (2025 supply) times CAA’s published 2027 final rates (CAA 2027 Oregon Producer Fees Schedule, published October 1, 2026).

Not in this sample: California and Washington (CAA has published 2027 schedules for both; a full check includes them). Minnesota and Maryland producer fees have not started: Minnesota funding starts in 2029 and Maryland reimbursement starts July 1, 2028. CAA also offers optional flat fees in Oregon and Colorado for producers supplying 10 tons or less; this company is above that.

6. Recommended plan

Essentials: up to 25 SKUs, all six states, $3,900 for the year ($1,950 to start, $1,950 at May sign-off). It covers California registration, prepared for your sign-off, and every 2027 report. CAA fees above are separate and paid directly to CAA.
